The Federal High Court in Ibadan has adjourned to May 11 a suit challenging the authority of the Economic and Financial Crimes Commission (EFCC) to audit the accounts of the Oyo State government.
The presiding judge, Justice Uche Agomoh, adjourned to May 11 to hear the preliminary objection.
The Oyo State government had filed the suit against the EFCC, the Attorney General of the Federation, the President of the Federation and the EFCC Chairman.
At the resumption of the suit on Wednesday, counsel to the Oyo State Government, Prof. Oyelowo Oyewo (SAN), who is also the Attorney General and Commissioner for Justice in the state, said the defendants had been served with the statements of claim but their responses were still pending.
Oyewo said the suit raises constitutional questions on the jurisdiction and power of the EFCC as a federal agency to monitor the power of the state governor.
Dr. Kemi Pinheiro (SAN), a lawyer representing the EFCC and its chairman, in his response, said he had just been served with the plaint and intended to respond.
Pinheiro said, however, that he will file an appeal to determine that the lawsuit is inadmissible.
